In the collection and processing of the information provided on the Site, SEMAE and FN3PT are two data processing managers, they undertake to comply with and ensure compliance with the regulations applicable to the processing of personal data and, in in particular, Regulation (EU) No. 2016/679 of the European Parliament and of the Council of April 27, 2016 applicable from May 25, 2018 (General Data Protection Regulation) and Law No. 2018-493 of 20 June 2018 relating to the protection of personal data.
When using the Website, the following may be collected: the URL of the links through which the User accesses the Website, the User’s access provider and his Internet Protocol (IP) address.
1. Purpose and basis for processing the personal data collected
The legal basis for the processing is the legitimate interest linked to the general interest mission of SEMAE as the recognized Interprofessional Organisation for seeds and plants to provide operators, namely professionals and consumers, with elements to improve knowledge and the transparency of the production and market of seeds and plants, including biodiversity, food safety, regulatory developments (legitimate interest within the meaning of the GDPR) and on the other hand the missions of the FN3PT in terms of promoting the plant of potatoes as a recognized association for organizing producers and carrying out research and development actions aimed at developing innovation and strengthening the quality and competitiveness of the French seed potato as an agricultural technical institute (legitimate interest within the meaning of the GDPR).
The purposes of processing personal data are:
• to deliver their order to the User (via the order form to be printed and returned by mail with payment to the FN3PT address indicated on the order).
In the order, the first and last name, company, postal details, telephone number and email address of the person are collected on a mandatory basis for the delivery and invoicing of the order.
2. Retention of personal data
Please note that each person completing the order form undertakes to provide accurate information about their identity. SEMAE on the one hand and FN3PT on the other hand keep the information thus collected.
This storage can, in certain cases, be carried out by service providers. As part of the management of personal data with service providers, SEMAE and FN3PT ensure that said service providers manage this data in compliance with current legislation.
The data collected is kept for a limited period, depending on the purpose of the processing. Also, this data will be deleted as follows:
- at the latest one year after the last order placed and processed by SEMAE or FN3PT;
- the data is deleted when the User requests the deletion of its personal data, except in special cases, upon receipt of the request according to the terms specified below.
3. Rights of access, opposition, rectification and deletion of personal data
The User is informed that he has a right of access, opposition, rectification and deletion of his personal data according to the conditions and terms of the applicable regulation.
The User can contact the data protection delegate of SEMAE at the following address at any time: delegue_protection_donnees@semae.fr and of the FN3PT at the following address: dpo@fn3pt.fr.
In this case, SEMAE and/or FN3PT undertake to communicate information on the measures taken as soon as possible, and in any event, within one month of receipt of the request. If necessary, this deadline may be extended by two months, taking into account the complexity and number of requests. SEMAE and/or FN3PT inform the applicant of this extension and the reasons for the postponement within one month of receipt of the request.
SEMAE and the FN3PT are entitled, if necessary, to oppose requests for access and communication of personal data that are manifestly abusive (due to their number, repetitive or systematic nature).
If the User notices that SEMAE or FN3PT do not respect their obligations regarding its personal data, the User can send a complaint or a request to the CNIL which is the competent authority in France. No personal information of the User of the Website is published without his knowledge, exchanged, transferred, assigned or sold on any medium to third parties, from the EU or from a third country, outside of subcontractors authorized by SEMAE and FN3PT.
The databases are protected by the provisions of Law No. 1998-536 as amended, amending Title II of the Intellectual Property Code, relating to the Provisions relating to the rights of database producers and transposing Directive 96/9 amended from March 11, 1996 relating to the legal protection of databases.
